Who is an Advocate/Lawyer?

Before knowing about the steps how to become an advocate, first, let us know who is an advocate or lawyer. An advocate or lawyer is a legal professional who is trained and licensed to practice law, provide advice and representation to individuals, businesses, organizations, and government departments in legal matters. They can also offer legal advice, draft legal documents, negotiable settlements, and represents their clients in court or in alternative dispute resolution forums.

Eligibility Criteria

Step 1: Law after 12th (Integrated LLB)

To become a lawyer, it is mandatory to have a 12th pass in any stream (Arts, Commerce, or Science) with at least 45% marks or above. After this, you must clear the CLAT (Common Law Admission Test). After passing the CLAT exam, you can take admission in any private college, apart from this, government colleges conduct their Own law entrance exam for admission in law colleges, like Delhi University in Delhi conducts the DULEE (Delhi University Law Entrance Exam) for admission.

After the 12th, you can do B.A.LLB, BCOM.LLB, and BBA.LLB. LLB is of 5 years after 12th. There are 10 semesters in 5-year LLB. The maximum age for doing LLb after 12th is 20 years for general and OBC category and the maximum age for SC and ST category is 22 years.

Step 2: Law after Graduation (Bachelor of Legislative Law-LLB)

To become a lawyer, it is mandatory to pass Graduation in any stream (Arts, Commerce, or Science) with at least 50% marks or above. After this, you must clear the CLAT (Common Law Admission Test). After passing the CLAT exam, you can take admission in any private college, apart from this, government colleges conduct their Own law entrance exam for admission in law colleges, like Delhi University in Delhi conducts the DULEE (Delhi University Law Entrance Exam) for admission.

After 12th, you can do 3 years LLB Course. There are 6 semesters in 3-year LLB. No age has been prescribed yet for doing LLB after graduation, that is, there is no age limit for studying law after graduation.

Step 3: Enroll in the State Bar Council

Once you have obtained your law degree, you need to enroll in a State Bar Council to practice law in India. The Bar Council of India (BCI) is the regulatory body for the legal professional in India, and each state has its own bar council. You can enroll in the State Bar Council in the state where you want to practice law.

To Become an Advocate you have to enroll in the State Bar Council. You need to fill Enrollment/Registration form and attach your law degree certificate and other required documents, pay the enrollment fee, and submit the enrollment form at the State Bar Council Office. Thereafter, you get the notification for a meeting at the Bar Council Office for verification of the attached documents and interview. Thereafter, on the next day you get the enrollment number through a WhatsApp notification.

Step 4: Give AIBE (All India Bar Exam) Exam

AIBE exam must be given after the Enrollment. The AIBE exam is conducted by the Bar Council of India twice a year, and it tests your knowledge of law and legal procedures. The AIBE is an open-book exam, which means that you can refer to your study materials during the exam. However, you need to score at least 40% to pass the exam and obtain the certificate of practice.

Step 5: Complete Internship

After Enrollment in the state bar council, you need to complete an internship with a senior advocate or a law firm. During the internship, you will be under the guidance of a senior advocate and gain practical experience in the field of law.

The duration of internship is typically one year, but it can be vary depending on the learning of the intern advocate. During this period, the intern advocate will also receive a stipend from the senior advocate or law firm where he/she is doing the internship.
